A property title transfer cost includes applicable land transfer tax and real estate lawyers fees, plus lawyers disbursements such as software charges  and Title Insurance depending  the requirements of your lender. 

In Ontario, you need a real estate lawyer to transfer land title of a property. Therefore without a real estate lawyer title cannot be transferred in Ontario.

Ontario Land Transfer Tax Exemptions

In Ontario, Land Transfer Tax is not applicable if the property transfer is between spouses or from a person to the family business or a transfer of a farming property between family members.

It is important to note that the legal fee for title transfer with a mortgage is higher because the real estate lawyer will be drafting transfer and mortgage documentation. In other words it is just like a purchse file, since all documentation is similar. Whereas, mere tite transfer without the need to deal with mortgage documentation is inexpensive.

  • Review of title search, writ search, title insurance. Drafting and registering all closing documents, including title transfer and mortgage documents and completing the real estate purchase per the highest standards and protocols. 
  • One Appointment/ Mobile Signing.

     

Third-Party Closing Costs NOT included in Fees:

  • Registration Cost per Transfer $78.79.
  • Law Society Levy $65.
  • Flat disbursements cost $126 + HST for one title search, two writ searches, two execution searches, bank charges, wire charges, conveyancer charges, software charges. Important Note: We have capped and disclosed third-party disbursements at $126+ Tax. There are no hidden charges last minute and no additional costs for the Independent legal advice certificate.

Our Real Estate Lawyer fee for a title transfer with a mortgage is $999 + Tax to add a name to the property. We charge flat legal fees and do not charge additional fees if your property value is higher. Please note that $999 + Tax will only be applicable if we have to deal  with mortgage instructions & documentation.  This title transfer is treated as a purchase file since all documentation is similar to a purchase file.

Lawyer fees to remove a name from the title.

Our Real Estate Lawyer fee to remove a name from a property title with a mortgage is $900 + Tax provided we have to pay off the mortgage and obtain a discharge of mortgage. If we do not have to pay off the mortgage or obtain any discharge of the mortgage then the legal fee is of $630.

We charge flat legal fees and do not charge additional fees if your property value is higher.

How to transfer land title from a deceased person?

A probate order or a survivorship application is required to transfer property from a deceased person. 

Land transfer tax is not applicable for property transfer from the deceased name.
