Divorce Requirements & Documents
Who Can File for Divorce in Toronto?
To apply for divorce in Ontario, you generally need
a legally recognized marriage, the required connection
to Ontario and a basis for establishing marriage
breakdown. Our team can also confirm the appropriate
court location for your application.
01
A Legally Recognized Marriage
You and your spouse must be legally married.
A marriage performed outside Canada may qualify
if it is legally recognized in Canada.
02
Ontario Residency
Either you or your spouse must generally have
been habitually resident in Ontario for at
least one year immediately before the divorce
proceeding is started.
03
Breakdown of the Marriage
Marriage breakdown is established through
one year of separation, your spouse’s adultery,
or physical or mental cruelty by your spouse.
For a separation-based divorce, you may start
the application before the full year has passed,
but the year must be complete before the divorce
can be granted.
04
Marriage Certificate & Supporting Documents
You will generally need to file your original
marriage certificate. If it cannot be obtained,
our team can explain the available procedure.
We will also request identification and any
relevant existing agreements or court orders.

Your Questions Answered
Toronto Divorce & Family Lawyer FAQs
Find answers to common questions about divorce,
separation agreements and working with our Toronto
family lawyers. Explore the guides and official
resources below for further information.
What is the difference between separation and divorce?
Separation occurs when spouses begin living separate
and apart, with at least one intending to end the
relationship. A court order is not required simply
to become separated.
Divorce legally ends a marriage and requires a court
order. You must wait until the divorce takes effect
before remarrying. A separation agreement does not
itself end a marriage.
How much does a divorce lawyer cost in Toronto?
Shaikh Law Firm charges $999 + HST for eligible
standard uncontested divorce matters. Court filing
fees and applicable additional expenses are separate.
Contested divorce and related family law work may
be billed hourly at $360–$600 + HST, depending on
lawyer seniority. The total cost depends on the
work required.
View our legal fees.
Do I need a lawyer for a separation agreement?
A lawyer is not required to draft every separation
agreement, but legal advice is strongly recommended.
The agreement may affect property, support,
parenting and other important rights.
Our lawyers assist with drafting, reviewing and
negotiating agreements tailored to your circumstances.
Read our
separation agreement Ontario guide.
How do I start a divorce in Ontario?
Start by identifying the appropriate application
and checking the legal requirements. The procedure
depends on whether you are applying alone or jointly
and whether you are seeking other orders.
Our Toronto divorce lawyers can assess the assistance
you need and explain the documents, filing and
service steps applicable to your matter. See our
uncontested divorce guide.
Do I need independent legal advice before signing
a family law agreement?
Independent legal advice helps you understand the
proposed agreement, its consequences and the rights
or obligations it may affect.
Each party obtaining separate advice can help
reduce the risk of misunderstanding and later
disputes, although it does not prevent every
possible challenge. Learn about our
independent legal advice service.
Can I meet with a family lawyer virtually or in person?
Yes. We offer virtual appointments and in-person
meetings at our downtown Toronto location:
TD Place, 161 Bay St., 27th Floor,
Toronto, ON M5J 2S1.
Both options are available by appointment.
Contact our team to arrange a suitable meeting
and confirm what information to prepare.
What does the free 15-minute consultation include?
The introductory consultation is an opportunity
to discuss the general nature of your enquiry,
identify the services you may need and understand
possible next steps.
Detailed legal advice, document review and
representation are outside the introductory
consultation. Legal work begins after the
applicable conflict checks and engagement
arrangements are completed.
