This agreement sets out the terms upon which Shaikh Law Professional Corporation, carrying on business as Shaikh Law Firm, will provide legal services to you for an uncontested divorce in Ontario.

Please read these terms carefully before signing the agreement below.

Scope of Legal Services

This is a limited-scope retainer for an uncontested divorce only.

Our services include:

• Reviewing the information and documents provided by you;

• Preparing the required uncontested divorce court documents;

• Filing the divorce application with the Court;

• Arranging for service upon your spouse, where required;

• Submitting the divorce application for judicial consideration;

• Responding to routine Court inquiries or requisitions relating to the divorce application; and

• Obtaining the Divorce Order.

The fixed fee also includes up to two hours of consultation relating to your uncontested divorce.

A Divorce Certificate following the granting of the divorce is not included.

Legal Fees

Our fixed legal fee is $999 + HST.

Total legal fees including HST: $1,128.87.

Court filing fees are payable separately and are currently:

• $224 when the divorce application is filed; and

• $445 when the divorce is submitted to the Court for judicial consideration.

Total Court Fees: $669.

The estimated total of legal fees, HST and Court fees is $1,797.87.

Additional Expenses

Routine law-office administrative expenses, including ordinary printing, photocopying and file-opening charges, are included in our legal fee.

Third-party expenses are not included. These may include process-server fees, international service expenses, translation expenses, Divorce Certificate fees and other third-party expenses reasonably required for your matter.

If your spouse must be served outside Canada, additional legal fees and service expenses may apply.

Uncontested Divorce Only

The fixed fee applies only while your divorce remains uncontested.

If your spouse files an Answer, disputes the divorce, makes additional claims or otherwise contests the proceeding, any additional work will fall outside this fixed-fee retainer.

The fixed fee does not include legal services relating to parenting, child support, spousal support, property division, equalization, Separation Agreements, contested motions, restraining orders, appeals, Motions to Change or other disputed family-law issues.

If additional legal services are required, we will advise you. A separate retainer or additional legal fees may apply.

Our current hourly rates for work outside the fixed-fee retainer are:

Ali Shaikh: $450 + HST per hour
Associate Lawyer: $360 + HST per hour

Your Responsibilities

You agree to provide complete and accurate information and to provide all documents reasonably requested by Shaikh Law Firm.

You must advise us promptly of any material changes to your circumstances or contact information.

Additional work resulting from incomplete, inaccurate or undisclosed information may fall outside the fixed fee.

Acceptance of Your File

Shaikh Law Firm will be formally retained after:

• We complete our conflict and eligibility review;

• You accept and electronically sign this Retainer Agreement;

• The required payment has been received; and

• We confirm that your file has been opened.

Shaikh Law Firm reserves the right to decline a matter before confirming acceptance of the retainer.

Acceptance of These Terms

By checking the acknowledgment box, electronically signing and submitting the form below, you confirm that you have read and understood this Retainer Agreement and agree to its terms.

You also confirm that you have had an opportunity to contact Shaikh Law Firm with any questions before signing.

Your electronic signature and submission constitute your acceptance of this Retainer Agreement.
